Booking Terms and Conditions

The booking terms and conditions are there for your protection as well as ours, it is very important that you take time to read these before accepting them.

 Terms & Conditions

1. This contract reflects the verbal agreement. It shall include any terms agreed prior to its issue. It shall be deemed un-accepted unless the booking fee is received

within 7 working days of the issuing date. No alterations can be made by the client

without prior approval from the Artiste. Please note: by completing and sending the booking

form, you agree that you are making a confirmed booking and entering into a contract

which carries your acceptance, in full of these terms.

2. The client shall have the right to cancel the booking by serving upon the artiste not less than

28 clear days’ notice in writing. In the event of the client wishing to cancel this contract

agreement for any reason other than Act of God or national disaster, and advance

reservation payment will be forfeited.

2.1 A cancellation fee of not less than 50% of the agreed fee will be due if the cancellation

is within fourteen days of the performance.

2.2 A cancellation fee of not less than 75% of the agreed fee will be due if the cancellation

is within seven days of the performance.

2.3 The whole of the agreed fee will be due if the cancellation is within 48 hours of the


3. Booking fee: You agree to our booking fee as detailed above which is payable in advance to

secure the entertainment. The booking fee is deducted from the total payable.

4. The balance should be paid by:

4.1. Bank transfer details on request up to 2 days prior to the event

4.2. Cash to the artiste once equipment has been set up and sound check completed.

4.3. Cheque made payable to Richard D J Ellarby up to 2 weeks prior to the event.

4.4. The artiste operates a no pay, no play policy. We are happy to accept full payment on booking

5. In the unlikely event that the artiste is unable to attend the personally due to accident or

sudden illness, the artist shall endeavour to provide a suitable substitute

offering a similar service at no additional charge to the client. In the event that the artist is unable to find a replacement a full refund of any monies paid in respect of this event will be refunded. This does not apply to circumstances detailed below.

6. Force majeure – The artiste will not be liable for failing to attend a booking,

where the reason for non-attendance or late arrival is caused by adverse weather

conditions (including snow and flooding), road closure, road traffic accident, vehicle

breakdown, fuel shortages, acts of terrorism, industrial action, or other unavoidable

circumstances deemed beyond our control.

7. The client will appreciate that suitable time for venue access, safe installation and

dismantling and safe removal of equipment from venue is required to addition

performance time. Therefore, the hirer and venue will allow suitable time for this (up to

60 minutes each side of booking times.) Where appropriate. The hirer will also inform the

venue, in advance, of the artistes requirements.

7.2. The artiste shall not be liable for any additional charges levied to the client by the venue in relation to

equipment assemble / removal timescales.

8. The artiste requires a minimum area of 2.5m deep by 3m wide for a standard disco

8.1 The client will ensure that safe and adequate power is available for the equipment. A minimum of 2 x 13 amp sockets located within 5M of the performance area.

9. The client ensures that they have verified venue power sauces are electrically safe and

conform to the HSE EAW Act 1989, and amendments thereafter.

9.1 Copies of the venues Electrical Installation Safety certificate must be made available upon request by the venue under law.

10. The client will inform the artiste prior to the performance date confirmation of

venue sound limiter installation and permission to use haze/smoke machine. Please note:

10.1 The artiste reserve the right to decline entertainment at venues where a sound

limiter is installed and is set to such a low limit to be unworkable.

11. The artiste agree to provide proof of Public Liability Insurance and certifications

as required by the venue.

12. The artiste will accept music requests in writing up to 3 days prior to the

booking and will do our utmost to play clients chosen requests, and we are happy to take

individual requests on the night.

12.1 The artiste cannot guarantee the inclusion of any deleted, obsolete or difficult to source requests either in writing or on the night of the booking.

12.2 Please be advised that the artiste reserves the right to play any track requested that contains explicit lyrics.

13. The client agrees to provide adequate supervision of guests and will ensure that the venue

management adequately supervises customers and staff on site premises.

13.1 Where the function may include guest under the age of 16 years, the client or parent is

responsible for them and not the artiste.

14. Abuse of threatening behaviour from any person will not be tolerated and will result in

the performance being terminated with no refund.

15. The client agrees that compensation for any loss or damage to the artistes equipment,

vehicle(s) or personal belongings caused by their guests, venue customers and/or venue

staff may be sought, including any additional costs.

16. The client agrees that the confirmed entertainments start and finish times as specified in

the contract are accurate and correct. Any extension beyond the confirmed finish time is

at the discretion of the DJ and the venue management and chargeable at £50 per hour.

17. From time to time the Artiste, or a member of their crew, may take photographs of the performance. These photographs may include individuals attending the event. If you do not wish for photographs to be taken or used publicly such as on the Artiste’s websites or other advertising media, notify the Artiste in writing.
